Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Vendifys.com (the "Platform"). It is part of our Terms of Service. By using the Platform as a Merchant or Customer, you agree to comply with this AUP. Violation may result in suspension or termination of your store and account.

1. Purpose

Vendifys is a multi-merchant e-commerce platform headquartered in Dubai, UAE, serving users worldwide. This policy ensures the Platform remains safe, secure, legal, and reliable for all Merchants, Customers, and partners.

2. General Principles

You must use the Platform in a lawful, ethical, and responsible manner. You are responsible for all content, products, and activity associated with your store.

3. Prohibited Products and Services

Merchants may NOT sell, offer, or promote the following on Vendifys:

  • Illegal products or services under UAE law or the law of your country or your Customer's country
  • Drugs, narcotics, controlled substances, and drug paraphernalia
  • Weapons, firearms, ammunition, explosives, and military equipment
  • Counterfeit, pirated, or stolen goods
  • Products that infringe intellectual property rights (trademarks, copyrights, patents)
  • Tobacco, e-cigarettes, and related products where prohibited
  • Adult content, pornography, escort services, or sexually explicit products where prohibited
  • Hazardous materials, chemicals, or unregulated supplements
  • Human remains, body parts, or protected wildlife and animal products
  • Financial scams, pyramid schemes, gambling where prohibited, or unlicensed financial services
  • Any product or service that is defamatory, obscene, harassing, or discriminatory

We reserve the right to determine, at our sole discretion, what constitutes a prohibited product.

4. Prohibited Content

You may not upload, publish, or transmit content that:

  • Is illegal, fraudulent, deceptive, or misleading
  • Infringes any third-party intellectual property, privacy, or publicity rights
  • Contains hate speech, promotes violence, or discriminates based on race, religion, gender, ethnicity, or sexual orientation
  • Contains malware, viruses, ransomware, or other malicious code
  • Contains spam, bulk unsolicited messages, or deceptive marketing practices
  • Is false, inaccurate, or impersonates another person or business

5. Payment and Financial Misuse

Given that Merchants connect their own payment provider via API keys:

5.1 You must NOT:

  • Use another Merchant's payment provider API keys or attempt to access, view, or extract keys belonging to others
  • Share, publish, or expose your own API secret keys, private keys, or webhooks in public areas
  • Use the Platform to process payments for products or services not listed on your Vendifys store
  • Engage in money laundering, card testing, fraudulent transactions, or unauthorized charges
  • Intentionally process chargebacks, false refunds, or fraudulent orders
  • Use Vendifys to circumvent your payment provider's Terms of Service, prohibited business policies, or fraud controls

5.2 Merchant Payment Responsibility: You are solely responsible as merchant of record for all transactions processed through your connected provider, including refunds, chargebacks, and disputes. Vendifys does not handle your sales funds.

6. API, Platform, and Security Abuse

You may not:

  • Attempt to gain unauthorized access to the Platform, other Merchant stores, accounts, or systems
  • Reverse engineer, decompile, or attempt to extract source code from the Platform
  • Use bots, scrapers, crawlers, or automated tools to access the Platform without our written permission
  • Conduct load testing, stress testing, or vulnerability scanning without authorization
  • Interfere with or disrupt the integrity, performance, or security of the Platform
  • Attempt to bypass or circumvent security measures, rate limits, or authentication
  • Use the Platform to store or transmit API keys in an insecure manner

7. Customer Data and Privacy

You must handle all Customer data (names, emails, addresses, order data) in compliance with our Privacy Policy and all applicable data protection laws (including UAE PDPL, GDPR, CCPA).

You may not use Customer data for spam, unsolicited marketing, or selling data to third parties.

You may not collect sensitive payment data (full card numbers, CVV) outside of your PCI-compliant connected payment provider.

8. Intellectual Property Abuse

You may not sell or upload content that infringes trademarks, copyrights, or other intellectual property rights. Repeated infringement will result in termination and may be reported to relevant authorities.

9. Spam and Marketing Abuse

  • No unsolicited bulk emails (spam) using Customer data obtained from Vendifys
  • No deceptive SEO practices, fake reviews, or false testimonials
  • No misleading pricing, fake discounts, or bait-and-switch practices
  • All marketing must comply with applicable anti-spam laws (CAN-SPAM, GDPR, etc.)

10. System Resources and Fair Use

You may not engage in any activity that places unreasonable load on our infrastructure, including sending excessive API requests, creating excessive stores to abuse free trials, or using the Platform to host content unrelated to e-commerce.

11. Legal Compliance

You are responsible for ensuring your business complies with all applicable local, national, and international laws, including but not limited to:

  • Consumer protection laws
  • Tax and VAT obligations for your sales
  • Export and import regulations
  • Data protection and privacy laws
  • Payment provider rules and PCI-DSS requirements for your own provider

12. Enforcement and Reporting

12.1 Our Rights: If we believe you have violated this AUP, we may, at our sole discretion:

  • Issue a warning
  • Remove or disable products or content
  • Suspend or limit payment provider connections
  • Suspend or permanently terminate your account and storefront
  • Report violations to law enforcement and/or your connected payment provider

12.2 No Refunds: Termination for AUP violation does not entitle you to any refund of subscription fees.

12.3 Reporting Violations: If you become aware of any violation of this AUP, including another Merchant's misuse of the Platform or compromised API keys, please report it immediately to info@vendifys.com.

13. Changes to This Policy

We may update this Acceptable Use Policy from time to time. The updated version will be posted with a new Last Updated date. Continued use of the Platform after changes constitutes acceptance.
